In most cases, individuals are required to obtain a positive LMIA decision before you can apply for the work permit to enter Canada. For employers, you will need to apply and be approved by ESDC unless professionals who are seeking entry into Canada are exempted under CUSMA or GATS.
The key points for the LMIA application are to comply with the following factors:
- Must show recruitment efforts to hire Canadian citizens or Permanent residents before hiring Temporary Foreign Workers (TFW)
- Must offer a wage that is equal to or greater than the prevailing wage stipulated for each province
- Must provide the working conditions that are in compliance with the provincial labour market standards
- For Low-Wage occupations, employers are required to meet minimum requirements to ensure they are in compliance with the ESDC requirements
- For High-Wage occupations, employers are required to provide the transition plans
- Pay $1,000 CAD for each candidate
- Increased cap requirements from 10% to 20%, and 30% for specific industries.
